<br />22:9376 <br /> <br />M I NUT E S <br /> <br />CITY COUNCIL AND TIlE ARCADIA REDEVELOPMENT AGENCY <br /> <br />ADJOURNED REGULAR MEETING <br /> <br />DECEMBER 1, 1977 <br /> <br />The City Council and the Arcadia Redevelopment Agency met in <br />an adjourned regular session on December 1, 1977 at 4 p.m. in <br />the City Hall Council Chamber. <br /> <br />I ROLL CALL <br /> <br /> <br />VARTANIAN <br />MATTER <br /> <br />PRESENT: <br />ABSENT: <br /> <br />Members Gilb, Lauber, Margett, Parry, Saelid <br />None <br /> <br />, <br /> <br />CONTINUED - "Thi"s matter was contiD:ued from November, 23 and the <br />attorneys for both the claimant, Peter Wallin, and the Agency, <br />Eugene Jacobs, presented testimony (SEE TRANSCRIPT OF THIS ENTIRE <br />PROCEEDING). <br /> <br />For the record Mr. Jacobs asked that the Summons and Complaint <br />in the Unlawful Detainer and the Declaration relative to and <br />proof of service of the Notice to pay rent be made part of the <br />official record. Mr. Jacobs also submitted an Opinion as the <br />Special Counsel to the Agency and to the attorney for Richard <br />Vartanian, Peter Wallin. This was accepted by the Council and <br />Agency members. <br /> <br />In the Opinion it was stated in part that nothing whatsoever has been <br />found to support the Claimant's position relative to redevelopment <br />benefits and Mr. Vartanian has no right thereto. The Council and <br />Agency members felt 'the matter should be resolved at this meeting <br />if at all possible.. and Member Gilb submitted for consideration <br />that the claim for redevelopment benefits be denied and that the <br />City forego the $5200 back rent. This was' concurred in by the <br />other members. <br /> <br />Mr. Wallin and his client then discussed this privately and upon <br />their return to the Council Chamber Mr. Wallin asked for time until <br />Monday, December 5 to advise the City Attorney in this regard. <br />Discussio~ then held on just when Mr. Vartanian could move all of <br />his equipment from 215 'E. Huntington Dr. Council and the Agency <br />then went into an executive meeting to discuss the matter and <br />reconvened. Mr. Jacobs stated that the members would be agreeable <br />to a date certain and that they would take action on the two claims <br />at this meeting. Mr. Wallin said there is no objection. <br /> <br />I <br /> <br />Acting as the City Council it was MOVED by Council Member Gilb, <br />seconded by Council Member Parry and carried on roll call vote as <br />follows that the claim relating to 25 N. Fourth Avenue be and it is <br />hereby DENIED. <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Council Members Gilb, Lauber, MBrgett, Parry, Saelid <br />None <br />None <br /> <br />Acting as the Agency it was then MOVED by Member Gilb, seconded <br />by Member Parry and carried on roll call vote as follows that the <br />claim relating to 215 E.
