Alberg <br /> <br />PRESENT: <br />ABSENT: <br /> <br />Councilmen Gilb, Parry, Pellegrino, Margett <br />Councilman Saelid <br /> <br />On MOTION by Councilman Parry, seconded by Councilman Gilb and <br />carried unanimously Councilman Saelid was excused. <br /> <br />On MOTION by Councilman Parry, seconded by Councilman Gilb and <br />carried unanimously the minutes of the adjourned and regular <br />meetings of August 7 were APPROVED. <br /> <br />APPEAL to the denial by the Planning Commission of an application <br />for a change in the General Plan from Single-Family Residential and <br />Commercial to Multiple-Family Residential at 536-554 W. Las Tunas <br />Drive. The appeal was filed by George Wiegand, dba Fairhaven <br />Development Corporation. The Cpmmission felt tha~ the change would <br />result in spot zoning for the site, the possible rezoning to R-2 <br />or R-3 zone would be inconsistent with the surrounding land use and <br />zoning and also that a change would be detrimental to the public <br />health and welfare and injurious to the property or improvements <br />in the area, The application was denied on a 4-0 vote with two <br />Commissioners absent. <br /> <br />Mayor Margett, declared the hearing open and Jerry Wilson, 733 Kline <br />Street, La Jolla, owner of commercial property at the southeast corner <br />of Las Tunas and Baldwin, said in part that in his opinion the <br />Planning Commission denial was based on sound and proper study; such <br />a General Plan change is unnecessary and the present zoning is a far <br />more efficient use of the 'land. He asked the Council to consider the <br />impact the existing restaurant adjacent to the proposed site would <br />have On residents of a condominium at this location, what with its <br />normal parking of cars, patrons coming and going at night, etc. He <br />continued that neighborhood shopping is needed now with the cost <br />of gasoline. He urged denial of the appeal. <br /> <br />No one else desiring to be heard the hearing was CLOSED On MOTION by <br />Councilman Gilb, seconded by Councilman Pellegrino and carried <br />unanimously. <br /> <br />The City Council concurred with Councilman Gilb in his observation <br />that they have all been supplied with pertinent data and they are <br />well aware of what the Planning Commission considered and that all <br />its reaSOnS are a matter of record -- that the City Council has the <br />power to overrule the Commission but it does not have the right to <br />do that unless it is not proper and in this particular case he <br /> <br />8-21-79 <br /> <br />- 1 - <br />
