<br />40F,... <br /> <br />Councilman Reibold moved that Resolution No. 2964 be adopted. <br />Motion seconded by Councilman Phillips and carried on roll call <br />vote as follows: <br /> <br />AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold and Dennis <br />NOES: None <br />ABSENT: None <br /> <br />RESOLUTION <br />No. 2965 <br /> <br />lNDEXED <br /> <br />The City Attorney then stated that if it were Council's desire to <br />proceed further, it would be in order to adopt Resolution No. 2965 <br />and upon their consent he presented, explained and read the title <br />of Resolution No. 2965, entitled: "A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF ARCADIA, CALIFORNIA DECLARING ITS INTENTION TO <br />IMPROVE LOUISE AVENUE AND LE ROY AVENUE WITHIN THE CITY OF ARCADIA <br />AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST <br />THEREFOR AND DECLARING THE WORK TO BE OF MORE THAN LOCAL OR <br />ORDINARY PUBLIC BENEFIT AND THAT THE EXPENSE THEREOF SHALL BE <br />ASSESSED UPON A DISTRICT". <br /> <br />1 <br /> <br />Councilman Phillips moved that the reading of the full body of <br />Resolution No. 2965 be waived. Motion seconded by Councilman <br />Camphouse and carried on roll call vote as follows: <br /> <br />AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold and Dennis <br />NOES: None <br />ABSENT: None <br /> <br />Councilman Phillips moved that Resolution No. 2965 be adopted. <br />Motion seconded by Councilman Reibold and carried on roll call vote <br />as follows: <br /> <br />AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold and Dennis <br />NOES: None <br />ABSENT: None <br /> <br />HEARING <br />(Lyon) <br />1 .; & 'I <br /> <br />Continued hearing on application of Mrs. Charlotte Lyon, represent- <br />ative of Field Enterprises, Chicago, IllinOis, for permission to <br />conduct the sale of the World Book Encyclopedia by door to door <br />solicitation. <br /> <br />The City Attorney informed Council that in compliance with its <br />request he had ascertained the formula upon which sales and/or <br />use taxes are collected and distributed in operations of this kind, <br />which is: Sales tax collected from a business having a permanent- <br />ly established location within Arcadia is reported as such and <br />returned 100% to the City of Arcadia. Sales made in town by a <br />place not having a permanently established place of business in <br />said town, and sales made outside of town, particularly outside of <br />the state where a use tax is collected upon the delivery and use <br />of the materials in the state and city, a use tax is collected in <br />the latter case and a sales tax in the former case. In those <br />instances the sales tax is remitted to the county and the cities I <br />within the county on the basis of the formula adopted under the <br />authority of the Recenue and Taxation Code; that formula is that <br />those taxes are distributed to the local agencies upon the same <br />proportion as sales taxes are reported from fixed places of. business <br />within the respective jurisdictions. <br /> <br />The Mayor asked Mrs. Lyon if she had any comments to make, to which <br />she replied that she had none other than to thank the City Attorney <br />for the comprehensive information he had obtained on the tax col- <br />lection question. <br /> <br />The Mayor asked if there was anyone in the audience who desired to <br />speak against the application of Mrs. Lyon, representing Field <br />Enterprises. There being no one, Councilman Camphouse moved that <br />the hearing be closed, which motion was seconded by Councilman <br />Jacobi and carried unanimously. <br /> <br />2. <br /> <br />1-7-58 <br />
