Bennie C. Flint, Pastor of the <br />First Baptist Church of Arcadia. <br /> <br />Mayor Phillips led in the pledge of allegiance to the flag. <br /> <br />PRESENT : <br />ABSENT : <br /> <br />Councilmen Balser, Camphouse, Jacobi, Reibold, Phillips <br />None <br /> <br />Councilman Camphouse moved that the minutes of the regular meeting <br />of December 16, 1958 be approved as submitted in writing. Councilman <br />Reibold seconded the motion and it was carried unanimously. <br /> <br />Mayor Phillips stated that regarding the proposed rezoning of Duarte <br />Road, between Holly Avenue and the present commercial zone near <br />Baldwin Avenue, that this matter would remain on the pending agenda <br />until a report is received from staff as to the sentiment of the area <br />residents on the costs involved for the cutting through of Arcadia <br />Avenue. <br /> <br />Continued matter regarding the application of Oscar Robins (dba <br />Bard Distributing Company) for a business permit to allow the <br />installation and operation of four skill game machines in'the Santa <br />Anita Bowling Courts. <br /> <br />The City Attorney stated that with reference to such skill game <br />machines, the City has in the past attempted to control their <br />location and manner of operation under Ordinance No. 823 which <br />amended Ordinance No. 737; that under said ordinance, in order to <br />sustain a denial of an application there must be evidence in the <br />record of the hearing on an application for a given location for a <br />given device; that although certain conduct might be suspicioned it <br />did not always come forth into the record; and that in an attempt to <br />close at least one of the avenues of abuse, namely, the use of <br />amusement and game devices as a means for petty and sometimes more <br />serious gambling, he wished to present for Council's consideration <br />Ordinance No. 1044, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF ARCADIA, CALIFORNIA, AMENDING ORDINANCE NO. 737 OF SAID <br />CITY BY ADDING THERETO A NEW SECTION NO. 23- A." <br /> <br />He added that the effect of this ordinance and its purpose will be: <br />(1) to provide a license fee of $25.00 per year for all items that <br />were previously referred to in subsection 19 of section 23 of <br />Ordinance No. 737, covering all types of amusement, skill games and <br />juke boxes where they are operated by or for money; (2) to permit <br />the substitution of like or similar machines or devices upon the <br />payment of $1.00 transfer fee to absorb the cost of the clerical <br />work in bringing 'the records up to date and to obviate the necessity <br />of coming before the Council for such purpose; and (3) to make it a <br />misdemeanor, punishable upon conviction by a maximum fine of $500.00 <br />or six months imprisonment, for any person utilizing any such amuse- <br />ment machine for gambling, betting, wagering or pledging anything of <br />value, or permitting the use thereof for such purpose. <br /> <br />1 <br /> <br />1-6- 59 <br />
