Considine <br /> <br />Present: <br />Absent: <br /> <br />Councilmen ,Arttt'" 13utterworth, Forman, Hage,:.Considine. <br />None <br /> <br />The City Clerk advised that pursuant to Government Code Section <br />35120, supplemental petitions protesting the proposed annexation <br />had been filed in her office on this date; that withdrawals of <br />protest had also been re~eived, but that time had not permitted <br />a staff tabulation and report. <br />,I : <br /> <br />Whereupon it was MOVED by Councilman Arth, seconded:by'Councilman <br />Forman and carried unanimously that the petitions of protest and <br />the withdrawals of protest be referred to the City Clerk and City <br />Manager for tabulation and report to be submitted at an adjourned <br />meeting, and that the public hearing on the matter be continued to <br />Monday, April 15, 1968, at 7 P.M., to which date'and time this meeting <br />was adjourned. Roy Jeppson, counsel for Mi'chillinda"Pa'tk As"s'oci~tion, filed with <br />the City Clerk, a report compiled by,"t!1e Title Insurance and Trust <br />Company. He stated in part that he thought said report would justify <br />,the inc'lusion of many of the protest:" "hich were excluded by the City <br />staff report of March 27, 1968; th'at 'the Association has ;lrguments <br />pertaining to the validity of the filing of any withdrawals of <br />protest after the first protest hearing; that in their opinion a <br />majority protest was made at the first hearing and he requested an <br />opportunity to be heard at the adjourned meeting. <br /> <br />Mayor Considine advised that the procedure at the aforementioned <br />meeting would depend on the results of the tabulation and report; <br />that if there are found to be sufficient protests over the fifty <br />percent, any further arguments would be needless.
